Getting an $8,100,000 Verdict on $30,000 Offer from State Farm – Jason Fowler, Ryan Kahl, Rex Parris

November 29 @ 11:00 AM - 2:00 PM PST

Wells v. Williams – $8.1 million verdict after State Farm rejects statutory offer to compromise for its $100,000policy limits and chooses to offer $30,000 to settle the case

On July 1, 2017, the plaintiff was involved in a T-Bone collision a few blocks from her house. The airbags did not deploy, and none of the windows in her vehicle were broken. She had no bruising, no bleeding, and no broken bones. She declines an ambulance ride to the hospital, choosing instead to go home with her husband. After going home, she goes to the hospital, where she is diagnosed with a concussion, but no imaging is done, and she is released. Throughout trial, the defense highlighted each of the above facts to try and minimize the continuing complaints the plaintiff was suffering. The defense also raised several preexisting health conditions plaintiff suffered from in order to try and explain her headaches and cognitive difficulties that she was experiencing. The jury rightfully rejected each of the defense arguments. This course will dissect why the jury saw through the typical defense arguments and was able to focus on the true facts in the case in order to award a just verdict to the plaintiff and her husband.

This course will discuss:

1. Case challenges and how to overcome those challenges
2. How to effectively address defense contentions pre-trial and during trial
3. Effective use of depositions in trial
4. How to deal with a likable individual defendant
5. Jury selection of an admitted liability case with an individual defendant
6. Closing Argument and rebuttal
